EU's Barnier: EU To Propose Bank Recapitalization Legislation
BRUSSELS (Dow Jones)--The European Union will prevent its plan to
recapitalize the region's banks from causing massive asset sales that would
hurt the real economy, Michel Barnier, the EU commissioner for financial
regulation, said Tuesday.
The European Commission, the EU's executive arm, will propose legislation to
coordinate the bank recapitalization plan, Barnier added.
Banks can improve their capital ratios either through selling new shares or
cutting their balance sheets. With bank stocks trading at rock-bottom
levels, some observers have worried that banks will largely opt to sell
assets, causing asset price declines that would leave banks in worse shape.
"We want to assure ourselves that there won't be a massive and sudden
'deleveraging,'" Barnier said in a statement during a meeting of EU finance
ministers here.

Equity futures are trading mixed to fair value. European markets are in positive territory, reacting to the volatility in the US in the last hour of trading: US markets first saw a knee-jerk rally on the Guardian report that an agreement on a €2T rescue fund had been reached, and then pulled back on the realization that the €2T represented the impact of leverage, and not an increase in the absolute size, and then subsequent headlines that the €2T figure was "totaly wrong". Underperformance in Nasdaq futures reflects Apple's (AAPL) earnings miss, while S&P and Dow futures are above fair value.
Bullish sentiment increases to 35.8% from 34.4% in the latest US Investor's Intelligence poll. Bearish sentiment decreases to 41.0% from 46.3%
Those expecting a market correction increases to 23.2% from 19.3%

S&P 500 may advance as high as 1,254 before falling at least 5.6%, technical analyst Tom DeMark wrote in an e-mail today.
This rally should squeeze short sellers and exhaust late buying: DeMark; The rally should be fast.
DeMark's prediction last month that the S&P's decline would stop at 1,076 proved prescient, it bottomed at 1,074.77

Attention will likely shift to the release of the FOMC's September minutes at 14:00 ET and numerous Fed speakers on the economy scheduled for today.
Bullish sentiment unchanged at 34.4% in the latest US Investor's Intelligence poll. Bearish sentiment increases to 46.3% from 45.2%
Those expecting a market correction decreases to 19.3% from 20.4%

US equity futures are following European markets lower as ECB's Trichet reiterated a sense of urgency in regard to dealing with the Eurozone Sovereign debt crisis in order to avoid contagion. The Slovakian vote on approving changes to the EFSF rescue fund is expected at ~7:00 ET is looking less likely to be approved though there are reports that the parliament can put the ratification to repeated ballot once a political agreement with the opposition is in place. Earnings season unofficially kicks off with Alcoa (AA) after the close.
EU/IMF/ECB inspectors say Greece will miss 2011 target, says Greek 2011 fiscal target no longer within reach.

IF THE losses at UBS that surfaced this month were caused by a “rogue” trader, would that make his colleagues stable? Not if research being undertaken by John Coates, a neuroscientist at Cambridge University and a former derivatives trader, is anything to go by. His work suggests that hormones drive investment decisions to a far greater extent than economists or bank executives realise. When traders are on a winning streak, their testosterone levels surge, sparking such euphoria that they underestimate risk. When they are acutely stressed, the adrenal cortex produces a flood of cortisol, a hormone that can make them overly fearful and risk-averse.

Financial Blue Moon
Sam Stovall, Chief Equity Strategist for S&P Capital IQ, pointed out this morning in his Sector Watch commentary that a financial blue moon of sorts has just occurred. The S&P 500 is currently yielding more than the 10-year Treasury bond.
Mr. Stovall explains: “The Farmers' Almanac defines a blue moon as an extra full moon within a season, which occurs only once in a…..while. But when it does, it is supposedly a sign of good luck. In investing, a rarity that occurs even less frequently than a blue moon is the dividend yield on the S&P 500 exceeding that for the 10-year Treasury note. Well, today is one of those days, as the S&P 500’s indicated dividend yield exceeds the yield on the 10-year note. On a quarter-end basis, this has happened only 20 times since 1953. The good news is that in the following 12 months, the S&P 500 rose by an average 20%. The bad news is that past performance is no guarantee of future results.
